Governor Gavin Newsom has signed into law two sweeping pieces of legislation prohibiting certain products containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS) in California starting on January 1, 2025.
PFAS are a category of as many as Nine thousands of fluorinated organic chemicals that may be used in consumer products or packing for a variety of uses. Certain PFAS are sometimes referred to as “forever chemicals” because they bioaccumulate and are long lasting in the environment.
What are PFAS substances?
PFAS (perfluorinated and polyfluoroalkyl compounds) are composed of about 9,000 compounds. Due to their extremely stable carbon-fluorine bonds, these substances have strong chemical stability. They are waterproof, stain-proof and heat-resistant. It is widely used in industrial production and daily consumption fields.
For the textile industry, PFOS (perfluorooctane sulfonyl compounds) and PFOA (perfluorooctanoic acid) are the two most familiar PFASs that affect reproduction and development, liver and kidneys, and the immune system, and can cause tumors. In addition, PFHxA, PFHxS, C9-C14 PFCAs, C9-C20 PFCAs, LCPFACs, etc. all belong to PFAS.
PFAS control requirements
Manufacturers must not intentionally add PFAS to textiles.
The content of PFAS (in terms of total organic fluorine) in textiles or parts shall not be greater than or equal to:
① From January 1, 2025, 100 ppm;
② From January 1, 2027, 50 ppm.
Special requirements: From January 1, 2025, outdoor clothing used in harsh and humid environments, if accompanied by a PFAS information disclosure and a "Made with PFAS chemicals" statement, will be allowed to be sold to January 1, 2028.
Definitions in the Health and Safety Act
Clothing:
"Clothing" means any of the following:
Everyday and formal clothing including but not limited to: underwear, shirts, pants, skirts, dresses, overalls, bodysuits, costumes, tank tops, dance wear, suits, sarees, scarves, tops, leggings, school uniforms, casual Clothing, Activewear, Activewear, Everyday Swimwear, Formal Wear, One Piece, Bibs, Diapers, Footwear and Everyday Workwear. Does not include personal protective equipment or US military specific clothing.
Outdoor clothing
Outdoor clothing for harsh wet environments.
Textile:
Refers to textiles commonly used in homes and businesses, including but not limited to apparel, accessories, handbags, backpacks, draperies, shower curtains, furnishings, upholstery, beddings, towels, napkins, and tablecloths. Excludes carpets, PFAS-containing treatments for processing textiles or leather, textiles for experimental analysis and testing, stadium awnings or fabric structures in other buildings, etc.
